A court case against a Co Antrim man who was charged with assaulting a police officer and dangerous driving collapsed after the PSNI lost his arrest warrant for more than two years, it can be revealed today.
The case against David Samuel Currell (29), was thrown out at Larne Magistrate's Court recently because the length of time it had taken to serve the warrant amounted to an abuse of process under the Human Rights Act.
He was charged with failing to provide a specimen of breath, dangerous driving, driving without insurance, driving without a licence, resisting police arrest and assaulting a police officer.
Currell's solicitor told the court that the case amounted to an abuse of process under human rights legislation because of the amount of time it had taken to execute the bench warrant.
He said: "The delay is absolutely unjustifiable and there's absolutely no reason why this man could not have been brought before court two years ago."
